NEXATECH ONLINE STORE REGULATIONS
§1. General provisions

These Regulations define the rules for using the NexaTech online store available via the store's website.

The Regulations specify, in particular:

rules for placing orders,

payment methods,
-
delivery conditions,
-
rules for withdrawal from the contract,

complaint procedure,
-
rights and obligations of the Seller and the Customer.

The Customer is obliged to read the Regulations before placing an order.
§2. Definitions
For the purposes of these Regulations, the following terms shall have the following meanings:
Store – NexaTech online store.
Seller – Bartłomiej Oskwarek running sales as an unregistered business.
Customer – a natural person, legal person or organizational unit making purchases in the store.
Consumer – a natural person making a purchase not directly related to business activity.
Product – a product offered in the store.
Order – a declaration by the Customer aimed at concluding a sales contract.
§3. Customer Account

Customers can make purchases:

after creating an account,

without registration as a Guest.

Account creation is free.
-
The Customer is responsible for the accuracy of the data provided.

The Customer should protect their login details.
-
The Seller may delete an account in case of violation of the Regulations.
§4. Products

The store sells home gadgets.
-
Products are new.
-
Product photos are for illustrative purposes only.
-
Product descriptions are prepared with due diligence.
§5. Placing orders
-
Orders can be placed around the clock.
-
To place an order, the Customer:
-
selects a product,
-
adds it to the cart,
-
provides delivery details,
-
chooses a payment method,
-
confirms the order.
-
-
After placing an order, the Customer receives an email confirming its acceptance.
-
The sales contract is concluded upon the Seller's acceptance of the order.
§6. Prices
-
All prices are given in Polish Zloty (PLN).
-
Prices include taxes required by applicable regulations.
-
Delivery cost is provided before placing the order.
§7. Payments
The Customer can pay for the order using the methods available in the store, in particular:

BLIK,
-
Visa,
-
Apple Pay,
-
Google Pay,
-
other methods supported by Shopify Payments.
Order fulfillment begins after successful payment confirmation.
§8. Delivery
-
Deliveries are made only within the territory of Poland.
-
Delivery is carried out via:
-
InPost Paczkomaty (parcel lockers),
-
InPost Kurier (courier service).
-

Products may be shipped from warehouses located in Poland or outside Poland.
-
Information on the estimated order fulfillment time is presented on the product page or during order placement.
-
The Seller is not responsible for delays resulting from the carrier's actions or events beyond the Seller's control.
§9. Right of withdrawal from the contract

A Customer who is a Consumer or an entrepreneur exercising consumer rights has the right to withdraw from a distance contract without giving a reason within 14 days from the date of receipt of the product.

To exercise the right of withdrawal, the Customer should send a clear statement to the Seller:

The Customer may use the withdrawal form provided by the Seller, but it is not mandatory.
-
To meet the deadline, it is sufficient to send the statement before its expiry.
-
The refund will be made using the same payment method as used by the Customer, unless the parties agree otherwise.
-
The refund will be made no later than 14 days from the receipt of the declaration of withdrawal from the contract. The Seller may withhold the refund until the returned product is received or proof of its dispatch is provided - whichever occurs first.

The Customer bears the direct cost of returning the product, unless the Seller informs about taking over this cost.
§10. Exceptions to the right of withdrawal
The right of withdrawal does not apply in cases provided for by law, in particular when the subject of the order are products:

made to the Customer's individual specifications,
-
made to special order,
-
which, after delivery, have been inseparably combined with other items,
-
supplied in a sealed package which cannot be returned after opening for hygiene or health reasons, if the package has been opened after delivery.
§11. Complaints

The Seller is liable to the Consumer for the non-conformity of the product with the contract in accordance with applicable legal provisions.

The complaint should include:
-
Customer details,
-
order number,
-
description of the problem,
-
expected method of resolving the complaint.
-

The Seller considers the complaint without undue delay, no later than within 14 days of its receipt, unless legal provisions state otherwise.
§12. Returns
-
The returned product should be properly secured for transport.
-
The Customer is responsible for any reduction in the value of the product resulting from using it in a way that exceeds what is necessary to ascertain its nature, characteristics and functioning.

The refund covers the product price and delivery costs to the extent required by applicable regulations.
§13. Seller's Liability
-
The Seller exercises due diligence to ensure that the information published in the store is reliable and up-to-date.

The Seller is not responsible for:
-
interruptions in the operation of the store due to technical reasons,
-
force majeure,
-
delays resulting from the actions of carriers,
-
incorrect data provided by the Customer when placing the order.
-

Limitations of liability do not apply to cases where their exclusion is inadmissible under applicable law.
§14. Out-of-court dispute resolution methods

The consumer may use out-of-court dispute resolution methods provided for by applicable law.
-
Information on available procedures can be obtained from the competent consumer protection authorities and on the EU online dispute resolution (ODR) platform, if available for a given type of case.

§15. Personal data (GDPR)

Personal data is processed for the purpose of:

order fulfillment,
-
maintaining a customer account,
-
customer contact,
-
handling complaints and returns,
-
fulfilling obligations arising from legal provisions.

Providing personal data is voluntary, but necessary for order fulfillment.
-
Data may be transferred to entities supporting order fulfillment, in particular:

Shopify,
-
Shopify Payments,
-
InPost,
-
product suppliers to the extent necessary for order fulfillment.

Data is processed for the period required by law or until claims are time-barred.
-
The Customer has the right to:

access their data,
-
rectify data,
-
delete data, if permissible by law,
-
restrict processing,
-
data portability,
-
object to processing,
-
lodge a complaint with the President of the Personal Data Protection Office.

§16. Cookies

The store uses cookies necessary for the proper functioning of the website.

Cookies may be used to:

maintain user session,
-
remember store settings,
-
handle the shopping cart,
-
ensure the security of the store's operation.

The Customer can manage cookies using their internet browser settings.
§17. Intellectual Property

All materials published in the store, in particular:

logo,
-
NexaTech name,
-
photos taken by the Seller,
-
product descriptions,
-
graphics,
-
visual identification elements,
-
are protected in accordance with applicable law.

Copying, distributing or using these materials without the Seller's consent is prohibited, except in cases provided for by law.
§18. Changes to the regulations
The Seller may amend the Regulations in the event of:-
changes in legal provisions,
-
expansion of store functionality,
-
changes in payment or delivery methods,
-
organizational changes affecting the provision of services.

Changes do not affect orders placed before the effective date of the new version of the Regulations.
-
The current version of the Regulations is available on the store's website.
§19. Final Provisions
-
In matters not covered by these Regulations, Polish law shall apply.
-
The Regulations are effective from the date indicated by the Seller.
-
If any provision of the Regulations is found to be invalid or ineffective, the remaining provisions shall remain in force.
-
By placing an order, the Customer confirms that they have read and accepted the content of the Regulations.
